GREENBELT, Md., Aug. 21, 2026 /PRNewswire/ — A proposed Settlement has been reached in a class action lawsuit against VSL Pharmaceuticals, Inc. (“VSL”) on behalf of individuals who are purchasers of VSL#3 between June 1, 2016, and June 19, 2019 (the “Class Period”). The class action lawsuit, David Starr et al. v. VSL Pharmaceuticals, Inc. et al., Case No. 19-cv-02173-LKG (S.D. Maryland), relates to Plaintiffs claim that Defendants falsely represented to consumers that the formulation of the probiotic VSL#3 that Defendants sold during the Class Period had been proven in clinical tests to be effective for certain medical conditions. Plaintiffs also claim that consumers who purchased VSL#3 during the Class Period overpaid for the product. Defendants are companies that licensed, marketed, and sold VSL#3 during the Class Period. Defendants dispute Plaintiffs’ allegations. It has not been determined in court whether Plaintiffs are correct.
What Does the Settlement Provide?
The Settlement provides the following monetary relief to Settlement Class Members who submit a valid and timely Claim Form:
- VSL will pay $20,000,000 into a Settlement Fund to settle all claims in the lawsuit brought on behalf of Settlement Class Members.
- The Net Settlement Fund will be distributed to Settlement Class Members who file valid Claim Forms. Payments will be calculated based on the number of units of VSL#3 they purchased, subject to potential adjustment of the per-unit benefit based on the volume of claims received and the amount available to pay claims.
- Settlement Class Members can receive a cash payment by submitting a valid Claim Form and, in certain circumstances, submitting supporting documentation.

Am I eligible to receive a payment from the Settlement?
You may be eligible to receive payment if you are an individual who, while living in the United States or its territories, purchased VSL#3 from June 1, 2016 through June 19, 2019 (the “Class Period”).
How do I get a payment from the Settlement?
You must complete and submit a Claim Form on or before October 20, 2026.

What are my rights?
If you are a Settlement Class Member, you may participate in the Settlement by completing a Claim Form online or mailing a paper Claim Form as described above. If you are a Settlement Class Member and either submit a Claim Form or do nothing, you will be bound by the Settlement and will give up any right to sue VSL in a separate lawsuit related to the legal claims in this lawsuit. If you want to keep your right to separately sue VSL, you must exclude yourself from the Settlement by October 20, 2026. If you do not exclude yourself, you may object to the Settlement and/or ask for permission to appear and speak at the Fairness Hearing by October 20, 2026. The Court will hold a hearing on January 6, 2027, at 2:30 p.m. at the United States District Court for the District of Maryland, 6500 Cherrywood Lane, Greenbelt, MD 20770 to decide whether to grant (1) final approval of the Settlement including the proposed plan of allocation and distribution, and (2) Class Counsel’s requested attorneys’ fees in the amount of one third of the Settlement Fund, reimbursement of Class Counsel’s costs and litigation expenses, and (3) A Service Award to the named Plaintiff. You and/or your own lawyer may appear and request to speak at the hearing at your own expense, but there is no requirement that you do so.
